ThinkGeek 's Win a Gift Certificate Drawing
PLEASE READ THESE OFFICIAL RULES CAREFULLY. BY SUBMITTING AN ENTRY FOR THIS CONTEST, YOU AGREE TO ABIDE BY THESE RULES. THIS IS A LEGALLY BINDING CONTRACT BETWEEN YOU AND OPEN SOURCE DEVELOPMENT NETWORK, INC. ("OSDN").
NO PURCHASE NECESSARY. To be eligible for the Win a ThinkGeek Gift Certificate Drawing (the "Contest"), you must: (i) be eighteen (18) years of age or older, and (ii) be a legal resident of the United States. Eligibility may be verified at any time.
This Contest is for United States residents only. Residents of Vermont, Arizona, Tennessee and Puerto Rico are not eligible to participate in the Contest. Void in the U.S. Virgin Islands and U.S. military installations. Employees of OSDN, OSDN’s parent corporation, and any of OSDN’s subsidiaries, affiliates, advertising and promotional agencies, and members of any such employee's immediate families or households, are not eligible to participate in the Contest. THIS CONTEST IS VOID WHERE PROHIBITED.
OSDN will award one $50 (fifty) gift certificate for ThinkGeek merchandise to one selected winner. No substitution, transfer, assignment of or cash equivalent for Prize permitted. Estimated delivery of the Prize is 4-6 weeks from the Drawing Date, defined below.
The Drawing and Notification:
The Prize will be awarded through a random drawing held on or about August 1, 2004 ("Drawing Date") conducted under the supervision of OSDN, whose decisions are final. Odds of winning depend on the number of completed entries received. Winners will be notified by e-mail. If a potential winner cannot be reached after a reasonable effort has been made during the ten (10) business days from the first notification attempt, or is found to be ineligible, or if he/she does not comply with these Official Rules, such person will be disqualified and an alternate winner will be selected. A potential winner will have thirty (30) days from notification to claim the prize, including returning appropriate documentation.
How to Enter:
The contest commences on June 24 at 12:01 a.m. and ends on July 31, 2004 at 11:59 p.m. For purposes of this contest, all times refer to Eastern Time. To enter, entrants must fully complete the name and email address section of the survey they are taking. Entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. Authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. If the potentially winning entry is an Internet or other computer entry, the potential winner may be required to provide OSDN with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. Limit one (1) entry per eligible individual, per email address, and per household. More than one entry from any one eligible individual, email address, or household will be automatically disqualified. All entries become the property of OSDN and will not be returned. OSDN reserves the right to publish the winners name and prize won. Other information will be kept confidential - OSDN does not transfer or resell its databases to third parties.
By entering this contest, entrants agree to release, discharge and hold harmless OSDN, and its parent company and/or subsidiaries from any and all liability (including but not limited to claims, damages, losses or injuries of any kind resulting from participation in this contest, and acceptance/possession or use/misuse of any Prize). Entrants also agree that OSDN is not responsible for entries that are late, delayed, lost, stolen, garbled, misdirected, illegible, mutilated, tampered with, forged, incomplete, damaged or otherwise not in compliance with these Official Rules (and such entries will be disqualified). OSDN is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, computer software, failure of any email or electronic notification to be provided by OSDN on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, including any injury or damage to entrant's or any other person's computer and/or its contents related to, or resulting from, participation in this contest. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, OSDN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Entrants agree to abide by the terms of these official drawing rules and by the decisions of OSDN, which are final and binding on all matters pertaining to this contest. This contest is governed by and interpreted in accordance with the laws of the United States. This contest is subject to all applicable federal, state provincial and local laws and regulations. This contest is void where prohibited or otherwise restricted under any laws, rules or regulations. The winner is solely responsible for the payment of any and all taxes, including income taxes, and/or licenses and/or other related local, state, and federal fees that may apply. Return of Prize or Prize notification as undeliverable will result in disqualification. If, for any reason, the drawing is not capable of running as planned, including infection by computer virus, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, OSDN reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the contest and conduct judging from all eligible entries received. Any individual who attempts to defraud or in any way tamper with the entry process will be disqualified and will be prosecuted to the full extent of the law. If applicable, entrants are bound by any and all prize limitations set forth in their company's policies.
The odds of winning the Prize are dependent upon the total number of eligible entries received.
Reservation of rights:
OSDN reserves the right, in its sole discretion, to cancel or suspend the contest should virus, bugs, unauthorized human intervention, or other causes beyond OSDN's control, in OSDN's sole discretion, corrupt the administration, security, fairness, integrity, or proper operation of the drawing. In the event of cancellation, OSDN may elect to award the Prize to winners drawn from among the entrants who have entered the contest at the time of cancellation.
This contest is subject to these Official Rules. By entering the contest, entrants agree to waive any right to claim any ambiguity or error in the Official Rules of the contest, or the drawing itself, and agree to be bound by these Official Rules and by all decisions of OSDN, whose decisions are binding and final.
